Use a BTC accelerator to speed it up. There is a couple just by googling it.

He's fine.
It'll either just take AGES to confirm or the BTC will get refunded to the sender's address.

I don't even know if it is possible for it to ever get refunded to the sender anymore?
I sent a payment and it didnt confirm for a week but it got to the seller eventually.
