Can a non-upgraded member make a contest with an ub3r?
Earlier, I had my friend contact a staff member if it was alright, and he said yes. But I want to make sure.
I'm going to make a 3p1c contest in a week or two weeks probably.

I guess yeah. But you have to give out the reward though, else you get banned for it. Also I don't think giving out 3P1C upgrades is a good idea because Omni was against the sales for it and I'm pretty sure a contest falls under that too. Omni wants people to use the OMC infrastructure and to make sure that as many people have a wallet as possible.

I heard that both of our accs are on the line if I fail to make the 3p1c upgrade.

It's the person that posted the thread. You'd have to send the OMC to the person though, I don't think you can gift 3p1c right now.
