It literally depends on what is and the purpose. I'm going to call this a moot point because there are no webcams accessible on the Internet and indexed by Shodan. One would have to go to some lengths to make that happen.

I was referring to cameras like WebcamXP 5 without authentication. Let's say those cameras are in a private space. What consequences would there be for viewing them?

Something like this? http://109.233.191.130:8080/ Totally legal. It's a public webcam. The webcam on someone's computer in their house? I don't think that it would fall under Title 18 U.S. Code 1030. There is a federal law against recording someone without their knowledge. And then hacking into a computer system is another felony.
