So last night I was speaking to this guy to sell him an eBay giftcard of $500 for $300 and he accepted so I sent him my address and he replied stating he doesn't have access to his wallet right now so we'll do this tomorrow in the morning. I wouldn of expect him to contact me before sending any payment out due to the fact multiple wallets dispensed addresses after a certain of time and we dont have access to these private keys so the guy sent the money to the address from last night that was dispensed and is no longer in my posessions. The BTC was lost and that's why this is a though situation.

You can't request a refund if the vendor doesn't allow refunds. You were sent your accounts so stop with the stupidity.

If you have an issue, open a scam report and let me post the proof you're items was sent.
