I believe they'll give it to anyone. If your account is/stays empty though, the name may get claimed by someone else.

Yeah the account name I got was made soon after MAL, had loads of comments on the profile but no posts, no updates and never online. Everyone was surprised I got it since a mod said no one could ever get this name :3 and then I got it.

MAL has pretty strong passwords tbh, also risk getting locked since it has happen before. Well not bruteforced but jacked.
