Advice for fighting fraud against my healthcare business

Warning this is incredibly long, I apologize

Heres the background you need to understand how we get defrauded: (Without fully doxing myself) I have a c-suite position at a very successful yet super small independent telemedicine company that primarily involves patients paying us for the visit & medications to then turn around and purchase said medications from mail order pharmacies who ship to the patient. Insurance is not involved at any level in this.

The reason we don’t just charge for the visit and allow the patient themselves to pay for the medication from the pharmacies is because not only is it much simpler for everyone but also the profit margin is significantly higher due to special pricing agreements we have.

Mind you, while the practice itself from top to bottom is 100% ours we operate on a platform that in essence perform four duties: payment processing (they mainly use what I can only assume is Stripe and less commonly Paypal), operate the servers and website, forward customer service questions/complaints to us, as well as advertising.

Here’s the fraud:

1. A patient will claim non delivery and charges back typically through their bank (the platform charges us a significant rate if we wish to fight these and they never win). Even though all deliveries have picture and signature confirmation.

2. Buyers remorse with totally illegitimate reasoning after they have paid us and we have have paid the pharmacy. It is mentioned 4-5 times that once they pay there is absolutely no refunds which they have to agree to in writing, all purchases are final, and even check a box saying so before paying. Yet they chargeback leaving us stuck with the cost of their medication, and most of the time it’s too late to intercept the delivery so they also get the meds for free.

3. The least common is a chargeback because of a lack of response to the medication, even with them full knowing the length of time and other things that they must do for it to work. This is the most aggravating for me because of the blatant stupidity.

On average last year we had a 3-5% loss in revenue due to this, so far this year the average is 2-3%. The buyers are basically fully KYC’d by us, copies of ID’s and all personal info that is fully verified. Several law firms have quoted retainers that don’t make financial sense and gave me the impression they aren’t even confident in their success rate.

However, I have a couple lawyers who owe me and are willing to right demand letters using their firms letter head. Obviously the threat of a lawsuit would be empty but apparently it does convince some people to do the right thing. Is this ethical in your opinion? Is this a bad look in the healthcare field? Is there a professional option that doesn’t involve law fare?

My other solution that I am beginning to form is creating our own platform where we run the payment processor and website however I cannot find a developer to save my life. I’m hoping there are some highly skilled folks here on HF willing to take on a very rewarding job, but that’s for another thread.

Any advice, criticism, suggestions, thoughts or questions would be appreciated if you ended up reading the 20,000 word novel.

You should definitely get your lawyer to write those letters. Your customers are not playing fair and abusing your systems for their gain, so yes, do it man.

So, here’s what you should do if I were you;

If they issue a dispute, perm ban them from ever paying with a card, and offer payment gateways such as cryptocurrency.

I can build you what you’re looking for but I’m really low on time right now. Hmu with more details and maybe we can work something out.

Good luck!
