I have seen in the deal dispute section multiple times people get scammed by users that already have an active deal dispute.

When I ask them why they dealt with this person, they usually say they didn't realize the user had a deal dispute already.

My suggestion is to have it more noticeable on a users profile if they have a deal dispute before dealing with them.

Warning on marketplace posts

I think the best place for a deal with caution would be on their profile, somewhere like this so people can see it, or something similar to your first idea.
