Items not sold on HF but not Copyright/patented

I have a question pertaining to software that does not have a patent or copyright that is sold on another website for obscene amounts. I have the SOURCE code for said program am I able to post it on here? or Can I only post information on how it works or create my own software based on how it works?
To my knowledge, technically speaking if it is not copyrighted you can take the exact coding and everything, change the name and colour of the program so to say, and sell it as yours.

I was not going to sell shit. I was just going to post the source code. I received.
I'd get consent from the original seller and then post it. If the original seller says no, then I wouldn't.

Product keys, key gens, serials and software cracks are not allowed. This includes the selling, trading, or requesting of any illegal unlicensed product keys. HF is not a warez forum and we will no longer tolerate our site being used as one.

Because there's no written copyright doesn't mean it's free for the taking. Regardless, it might fall under that.
Personally I'm against the use of someone elses code in any way shape or form without their consent but I think it is important that you know that;
  • "computer programs, to the extent that they embody an author's original creation, are proper subject matter of copyright."
  • "Copyright Act gave computer programs the copyright status of literary works"
  • "Assuming that you're in the US, everything someone writes is considered to by copyrighted from when it is created"

Is that software under any open-source licences ?
Fiat justitia ruat cælum

My era of providing technical support and malware removal on HackForums is over, so you can stop PM'ing me about it. Sorry.

I have looked through the code and there are only "//this is what this does" tags it has nothing saying "who coded it" or anything like programmers usually stick at the top of every source file.

I am in Japan, and what your saying is since its not patented I can just write my own program using the original as a model and using a different language to code it from the ground up.
It's being sold somewhere else? No you may not post the source here. That's leaking.
