User asked me for $30 up front. I paid - I have received 2 screenshots and no files yet he insists on my paying another $50 (which is the complete BUDGET which I did state was my allotted amount to be considered when the job was done)
So overall I have paid this user $30 for 2 screenshots.
I honestly thought paying up front an amount was something to do to provide proof you were interested in the service and you would pay the rest after the job was done. Obviously I was wrong.

28 but yeah I think if he wants to be paid an amount up front, then the rest after the job is completed then admit he hasn't completed the job - why should I pay? Also why would I pay the full amount of my budget when the job was not up to scratch nor completed?

After doing a 30(ish) minute join.me session and still watching with Phixel with what Mr. Robot requested, I can definitely say this is feasible. What was done was that Phixel took a standard base template he created for another forum I'm assuming and actually implemented the requested style by Mr. Robot to that base. This is exactly what Mr. Robot requested in such that he wanted it to be a similar template to the Ribil / HACKD theme he sent to Phixel, but not the same. As demonstrated on join.me, Phixel has completely redesigned one of his base themes into what Mr. Robot asked for, but using his own framework. I can vouch that the code is not the one from the free released template that I and many others accused Phixel of doing.
This being said, the mentioning of the free template is completely out of this picture as if Mr. Robot wanted that theme, he could have easily downloaded it himself. But, because the code is not the code provided in that free template, Phixel is not in the wrong has he is personally writing the code and modifications to Mr. Robot's initial request and simply using an existing template as his framework which is a standard practice by many theme developers. Also, Phixel initially messed up the template he had for Mr. Robot due to frustration I'm assuming and decided to start from scratch on join.me and develop from there and it's actually turning out exactly how Mr. Robot requested.
Conclusion:
The $30 deposit should be kept by Phixel because he has spent the time to do what Mr. Robot has requested but because that same template he wanted recreated is also free, the assumption is now that Phixel has just copied the code over and called it his; this is not the case. I suggest Mr. Robot to pay the remaining after Phixel can come up with the finished product and shown to Mr. Robot before the remaining payment is made if Phixel wishes to still work for Mr. Robot. However, requesting the remaining payment is not necessary until there is 100% finished work to Mr. Robot's standards and is ready to be sent once the remaining payment is received. If either one of you are hesitant, then use a middleman and close both reports as resolved. I don't feel bad if $30 is lost in this case due to there being actual work done but Mr. Robot refusing it or making excuses.
I do apologize to Phixel for assuming and jumping to conclusion. However, Phixel, you do have to realize where I and everyone else stand as you were not willing to prove us otherwise until this got taken too far. I have fixed my rep for Phixel to +3 as I can say that this work is legitimate and custom to what Mr. Robot wanted. If neither of you wish to figure something out to resolve this, Mr. Robot, you have no reason to call him a scammer for keeping the $30 as the purpose of it is to not have someone request his work then waste time.
Please note that this is from me not knowing either one of these members until running across this thread. I am not on either side as I think both are equally wrong when it comes to handling this type of situation.
